This website https://lashharmonypro.co.uk is made available subject to complying with our Terms and Conditions set out below and should be read in conjunction with our Delivery and Shipping Notice and our Privacy and Cookies Policy. These counterparts together constitute an agreement by the user to be bound by these terms. If you do not wish to be bound by these Terms and Conditions, you are advised not to use the website.

2. WEBSITE ACCEPTABLE USE

Lash Harmony retains the right at its sole discretion to deny access to all or parts of the website, to close down accounts of users and change any eligibility criteria at any time and for whatsoever reason.

You may only use this website for lawful purposes when purchasing products or services from Lash Harmony as available on the Website and in accordance with these Terms and Conditions. Lash Harmony reserves the right to cancel or suspend any agreement for services on the Website at any time at their sole discretion.

Where we manage personal data, we identify as a Data Controller and will take appropriate steps to comply with our obligations under data protection law. 4. ACCESING OUT SITE

Users of this website must be at least 16 years old and be legally capable of entering into binding contracts. Access to those under 16 years old is not permitted. If you are entering into this agreement on behalf of a company or other legal entity or person, your continued use represents to us that you have the authority to bind such entity or person to these Terms and Conditions.

The information and services available on the website are provided for the purpose of providing products, services and training by Lash Harmony. These Terms and Conditions shall be in force on your use of the website and registration of an account.

5. YOUR STATUS

Lash Harmony products on our website are only available for sale to qualified lash therapists (or those undergoing one of our training courses). We may ask for proof of qualification and reserve the right to refuse to process any orders where this is not provided within a reasonable period, or if we have any reasonable cause for concern.

We reserve the right to verify your identity and also to carry out any checks we determine are necessary to supply our services to you.

6. PERSONAL INFORMATION

By placing an order/booking treatment/or a place on one of our training courses, you agree and understand that we may process your personal data in accordance with our Privacy Policy.

When you provide us with your personal data, you are responsible for ensuring that it is accurate. The name you provide will appear on any certificates that we award.

You agree to place orders only under your real name and with your real contact details, unless you are placing an order on behalf of somebody else in which case you agree only to place orders using their real name and contact details with their prior permission.

7. TERMINATION

We reserve the right to limit or prevent access to the Lash Harmony website on a temporary or permanent basis for any user, if there is a breach of our Terms and Conditions. If any user consistently breaches these Terms and Conditions, we may at our sole discretion terminate and / or block or limit access to the website.

8. DEFINITIONS

In these Terms and Conditions, the following meanings shall apply:

“Client” “Order” any user, individual, or company, that places an order via the Website

“Order” the placing of an order online via our shop for products/treatments by Lash Harmony

“Personal data” information that enables a person to be individually identified

“Product” applies to the range of items by Lash Harmony available online via our shop

“Therapist” you, the client purchasing our products or the attendee on a Lash Harmony training course

“We” “Our” or “Us’ refers to Lash Harmony

“Working day” any day other than Saturday, Sunday or a public holiday (recognised in England)

9. PURCHASING OUR PRODUCTS

Our display of products on our website is an invitation and not an offer to sell those products to you. An offer is made when you place the order for your products. However, we will not have made a contract with you unless and until we accept your offer.

Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the products you have ordered shipped by us to the address you have given us. We retain the right to accept or refuse orders at our sole discretion. Clients will be informed of any orders which we refuse or are unable to fulfil.

10. PRODUCT DESCRIPTIONS

We take reasonable care to ensure that the descriptions of our products are correct. We try to display as accurately as possible the appearances, colours, textures or finishes of our products. However, what you see will depend on your computer equipment, screen or monitor and we are therefore unable to guarantee that a product’s images are an accurate representation of the actual product. All measurements given are approximate.

11. PRODUCT AVAILABILITY 

We try to keep the website as up to date as possible but cannot guarantee that particular products will always be available. If we are unable to supply a product you have ordered, we will contact you to let you know and you will be entitled to a refund or credit towards another purchase.

12. PRICE AND PAYMENT

The price for all products on the website, https://lashharmonypro.co.uk, is shown in (£) UK pounds and includes VAT for UK and EU orders, where applicable. The cost of shipping will be given in (£) UK pounds. For orders outside the EU, where VAT (or VAT equivalent) may not be applicable, clients are not entitled to any discount or refund to account for the differences in tax treatment and will pay the same price for the item as a client placing an order for delivery to the UK and EU.

If you choose to pay for your order or course using a payment card with a currency denominated account that is different from the currency you are paying in, your payment card will be charged in the payment currency at the foreign exchange rate applied by your relevant payment card provider or bank at the time of processing your order / course booking. Your international payment card provider or bank will determine the foreign exchange rate and may add an additional processing or administration charge which you will be liable to pay. We have no liability for any such additional processing or administration charges, or for the currency exchange rate applied to your purchase.

For countries where an import duty may apply you are advised to check this in advance of purchase. We shall have no liability for any local import customs, taxes or other monies due in relation to products sent outside of the UK.

13. ORDER CANCELLATION

Once an order has been shipped it cannot be cancelled as performance on the contract has started. However, under the Consumer Contracts Regulations, if you are a consumer in the UK, you have the right to cancel or withdraw from a distance selling contract within 14 days from the day after delivery of the order. Orders must be retuned without signs of use and in original packaging. You are advised to refer to our Shipping and Returns Notice for further information.

14. TRAINING BOOKINGS

Training course bookings are made subject to availability (and in some cases prior qualification) and your place on a particular training course provided by Lash Harmony is only confirmed once your deposit payment has been received by us. Please note that the deposit is non refundable. The balance of the cost must be paid to Lash Harmony at least 5 working days before the start of the course.

If you need to change the date of a course, we will endeavour to accommodate the request, which may depend on a course and trainer’s availability. You should notify us of such a request at least 14 days before the course date. In some circumstances we may have to reschedule a course and if this happens we will refund any payments already received from therapists if they cannot attend on the rescheduled date.

Full day courses include refreshments. Lash Harmony do not offer any refund for part or all of a course if you fail to attend are delayed or leave early.

15. MODELS

Therapists attending our training courses may be required to provide a live model to practice. It is the responsibility of therapists to arrange the model themselves. If there are any difficulties with this, you should contact us directly. Lash Harmony does not guarantee to arrange a suitable model and if a therapist does not have a model, practice will be on mannequin heads or a model may be shared between therapists.

16. STUDENT KIT

It is recommended by us that you purchase a Student Kit prior to attending a Lash Harmony course. These are not included in all courses cost. Purchases can be made directly from the website. If you do not purchase the student kit, the tools will be provided by us for a practical part of the course which remains the property of the academy.

17. CERTIFICATES

Lash Harmony will issue certificates to therapists that it determines have met the qualifying criteria for qualification at its sole discretion.

Therapists attending a Lash Harmony workshop will receive a certificate of attendance only. Certificates will be posted via Royal Mail to a therapist’s contact address or given in person after course completion. You are advised to refer to the details posted on our website before booking onto a course for further details.

18. TRAINERS

Lash Harmony shall appoint suitable trainers to teach courses at its sole discretion. All appointed trainers will be checked to ensure they are suitably qualified and have the correct certification and accreditations as appropriate. No particular named trainer is guaranteed.

Although we have an appointed trainer for different locations which may be shown on the website, we reserve the right to change the trainer for any course without notification.

19. CONFIDENTIALITY AND DATA PROTECTION

Lash Harmony will adhere to all national data protection, data transfer, and data retention laws and regulations. We store all data securely. All personal and sensitive information that you send to us or forms part of our communications, will be kept confidential and will not be given to any unauthorised third parties except as required by law. Personal data may be provided to third parties we use to provide our services and we reserve the right to contact all course attendees with specific information in order to fulfil our contractual obligations and legitimate business interests.

We do not disclose personal data to any third parties except those who have contractually agreed to our service terms and conditions. Data is not used or sold outside of the agreed terms and conditions. We retain the right to respond to legal requests as necessary. 20. INTELLECTUAL PROPERTY

Lash Harmony reserves the right to all intellectual property in relation to this website and the services provided. Use of the services does not give the user any ownership in the services, its content or any trademark or logo used on the website by Lash Harmony.

Any information or material provided to us is on the basis of a non-exclusive, irrevocable, perpetual and royalty free licence to use such information and material in relation to the services we provide under our Terms and Conditions.

21. CHANGES TO TERMS AND CONDITIONS

These terms and conditions may be modified from time to time and you are advised to check this page to see that you are reading the most up-to-date Terms and Conditions.

22. DISCLAIMER

Lash Harmony has taken every care in the preparation of the content on this website, but to the full extent permissible by law we disclaim all responsibility for damage or loss howsoever arising including but not limited to loss of projects, loss of profits, loss of data or consequential or indirect losses arising in contract, tort or otherwise from the use of or inability to use the website and/or any information or materials on https://lashharmonypro.co.uk. Nothing in these Terms and Conditions shall exclude or restrict our liability for death or personal injury caused by our negligence, for fraudulent misrepresentation and/or any other liability which shall not be excluded or limited by law.
